Once again, Maine’s historically religious Blue Law will ban large retailers from opening on Thanksgiving Day, preventing many stores from meeting demand for last-minute food shopping or opening early for Black Friday sales.

Multiple efforts in the Legislature have sought to amend restrictions on smaller grocers and other retailers, most recently at the insistence of markets in Holden and Searsport, but to no avail.

The law has a raft of exemptions, including for stores with fewer than five employees and for stores with fewer than 5,000 square feet of interior selling space. Convenience stores selling last-minute staples are allowed to be open, if you’re in a pinch.

The perpetually open L.L. Bean is perhaps the most notable exception. The store, which for decades has remained open 24 hours a day, has claimed an unchallenged exemption from the rule. The law also has a special exemption for “establishments primarily selling boats, boating equipment, sporting equipment, souvenirs and novelties.”

Those exemptions didn’t crop up overnight. Lawmakers for years have added to the law that began as a way to preserve family time and recreation on holidays and Sundays — identified in state law as the “Lord’s Day” until 1985.

That’s put the law in the crosshairs of various legal challenges. An attempted takedown of the state’s right to even have such a law, with such broad exemptions, failed in 2002.

In that year, a federal judge dismissed a complaint by a Kittery motorcycle seller that sued the state, arguing it was unfair and unconstitutional for Maine to group and restrict its business along with car sales, which are prohibited on Sundays. The dealer argued its business was more appropriately grouped with sales of recreational vehicles, such as boats, ATVs and snowmobiles, which can be sold on Sundays.

In the 2002 decision, U.S. District Court Judge D. Brock Hornby writes that the original purpose of those Sunday closures came from Christian doctrine.

“But over the years, with changing social mores, legislatures have allowed many exceptions, and no longer is the legislation defended or attacked on religious bases,” Hornby wrote. “Instead, it has come to be recognized as serving a secular purpose in contemporary society.”

And that purpose, he wrote, is “preserving a day when family members are free of work and can be together, yet allowing them to spend that time recreating, and therefore allowing many services and products to be reasonably accessible, i.e., through vendors open for business.”

In the decision, Hornby wrote that the collection of exemptions in the law was illogical, describing the list as “a patchwork quilt of accommodations sewn together over the years.”

But that’s within the Legislature’s right.

“The resulting list of what can be done on Sunday and by whom is not logical, but it does not have to be,” Hornby wrote.

He concluded: “The statutory scheme is illogical, but not unconstitutional.”

The legislative record gives some insight into the law’s evolution.

The revisions start in 1971, when “public dancing” was added as a permissible business activity on Sundays. In 1973, mobile home sellers got the all clear for Lord’s Day sales, as did the inanimate “machines that vend anything of value, including, but not limited to, a product, money or service.” Pharmacies and drug stores got the OK, too.

In 1977, it was bowling alleys. In 1981, it was the rather obscure “satellite facility approved by the Superintendent of the Bureau of Banking… or comparable facility approved by the appropriate federal authority.” The bureau is now called the Bureau of Financial Institutions.

Then, only through the will of 52.5 percent of the state’s voters, retailers with fewer than 5,000 square feet of interior space got the ability to open on Sundays and holidays, in a 1990 referendum.

Businesses approached the issue twice recently, in 2013 and 2015 legislative sessions. But four separate bills failed during those sessions. It leaves open a question presented by the 2016 election, in which voters decided six issues by referendum: If businesses want to be open for future Thanksgivings, will they have to send this issue, too, out to the voters?

With the online sale starting on Sunday, it’s in your wallet’s best interest to shop early. That way, you’ll have a better chance of snagging inventory before it sells out. However, Best Buy’s sale isn’t restricted to just Sunday and Monday — a number of deals will hang around all week.

Best Buy will also likely have daily deals during Cyber Week, and it’s worth checking the site early every day to see what’s being offered. You don’t want to miss out!

How Do Best Buy Cyber Monday and Black Friday Sales Differ?

The biggest difference between Best Buy’s Black Friday and Cyber Monday events is that the latter lacks multiple days of early access sales, as well as in-store-only doorbusters. Generally speaking, you can expect both sales to feature similar types of items. We may even see some Black Friday deals return during Cyber Week.

What Best Buy Cyber Monday Deals Will Be Available?

Last year’s Best Buy ad was filled with deals on electronics of all types, but TVs were the headline deals, taking up most of the space in the first few pages of the ad. One excellent offer was a Westinghouse 50″ 4K smart TV for $200, one of the lowest prices we’d ever seen for a 50″ 4K set.

We may see some Black Friday deals return during Cyber Week.

Laptops were another strong category — a couple of Staff Pick deals on laptops from Best Buy were active on Cyber Monday. (Staff Picks are offers we consider the “best of the best.”)

Best Buy also offered a wide variety of deals on smartphones, although the best deals generally required activation on specific carriers.

In general, you should be prepared to shop fast, and to jump on a good deal when you see it. Sunday and Monday should be the best days to shop, having more deals than other days during Cyber Week. Quantities of in-demand items will likely be limited.

Remember that Best Buy’s site can experience slowdowns on both Black Friday and Cyber Monday due to high traffic. You might have to refresh pages several times in order to add an item to your cart and then check out. Try to be patient.

How do I get the most out of Cyber Monday?

Cyber Monday is the online version of Black Friday. Throughout the day (and in the days prior), online retailers will be selling all sorts of products at massive discounts that you won’t find the rest of the year. It’s one of the best days of the year to buy tech, depending on what devices you’re looking for.

Based on our experience, these are our best Cyber Monday shopping tips:

  • Research what you need. It’s easy to be tempted by snazzy-looking deals. But even though you’re shopping for discounts, you still don’t want to waste money on junk; you want tech that suits your needs, and tech that will last. We recommend figuring out what new devices you need well in advance of Cyber Monday, and reading reviews to find the model that’s best for you. Take a look at retailers’ Cyber Monday ads from last year to get an idea of what might be on sale this year.
  • Find the best price. You don’t want to make a purchase from Walmart, only to find out that Target had the same product for $20 cheaper. Once you’ve decided to buy something, make sure you’ve found the retailer that’s offering it for the best price. Use a price-comparison engine such as ShopSavvy or PriceGrabber, or a tracker such as Camelcamelcamel.
  • Shop safely. With so many folks shopping, Cyber Monday is a gold mine for scammers. Make sure to only purchase from retailers you trust, use a strong password for all of your shopping accounts, and don’t click on sketchy links — especially from unfamiliar emails.
  • Be prepared for a weird schedule. Some Cyber Monday deals are released in very limited quantities and can be gone in minutes — or even seconds. And on such a busy day as Cyber Monday, it’s not uncommon for products to sell out. To make sure you get the deal you want, you should plan to take advantage of popular deals as soon as possible after their release. The good news is that most outlets will release their upcoming deals well ahead of Cyber Monday, so you can plan ahead (and set an alarm if need be). And make sure you’re following major retailers on social media, or subscribed to their newsletters, so you’ll hear about their newest discounts as they drop.
  • Know what NOT to buy. The weekend after Thanksgiving is a great time to buy a lot of tech products — but not all tech products. The biggest consumer gadgets (particularly smartphones) tend to see their biggest discounts on Black Friday, rather than Cyber Monday. Other tech to steer clear of: TVs (you’ll get lower prices in December and January), DSLR cameras (these get their biggest discounts in February), and kids’ toys (you’ll see better sales leading up to Christmas).

Quickly on the heels of Black Friday and Cyber Monday deals come the number crunchers sharing just how the holiday shopping season is actually shaping up.

The Consumer Technology Association says that this is the year that the number of mobile (smartphone/tablet) shoppers has finally approached the number of online shoppers using desktop or laptop computers.

“The 2016 holiday shopping season is the tipping point for mobile shopping,” said Shawn DuBravac, Ph.D., chief economist, CTA, in a statement. “Consumers are shifting increasingly to mobile shopping, due to higher ownership rates of mobile devices and increasing ease, comfort and convenience.

It’s also been a record year for tech, according to the CTA, which says some 61.7 million American adults have bought or plan to buy technology products over the course of the big holiday shopping week. Ironically, most still are doing so in brick-and-mortar stores. The top tech purchases are TVs, tablets, smartphones and video game consoles, and total tech spending is expected to hit $36 billion this holiday shopping season.

The number of U.S. adults shopping during the week that began on Black Friday, Nov. 25, has risen to 135.9 million, up 6% from a year ago, according to the CTA. Of those, 76% shopping in physical stores and 57% shopped online (some did both).

Another booster of consumption, the National Retail Federation, is also buoyed by survey numbers. It says 122 million Americans plan to shop online on Cyber Monday, up from 121 million who planned to do so last year (based on numbers from Prosper Insights & Analytics).

Like the CTA, the NRF sees mobile shopping on the rise. It says more than 28 million people, nearly a quarter of Cyber Monday shoppers, plan to shop via mobile devices this year on Cyber Monday (that’s actually down a smidgen from last year).

Early morning looks to be the most popular time for Cyber Monday shoppers to snag their bargains. So supposedly, they won’t be killing too much productivity during the work day…

I’d argue Best Buy in particular has stronger deals than Target for Cyber Monday, but there are still some excellent discounts here:

Cyber Monday TV tip: always remember to check the specific TV model when retailers release them before making a purchase. Even the best manufacturers have weak models in their line-up that you are better off avoiding, so do your research.

Solid Deals

While Target has some decent Cyber Monday deals here, what stands out is how unexciting the products themselves are. As such they will be useful if you are in the market for them specifically, but they are unlikely to inspire shoppers to rush to their computer screens and local stores:

Cyber Monday falls on Monday after Thanksgiving in the United States. According to Wikipedia article on Cyber Monday the term “Cyber Monday” was created by Ellen Davis based on 2004 research showing that one of the biggest shopping days of the year was the Monday after Thanksgiving. Marketing companies quickly seized the term to attract more people to online shopping. With each year the sales increase and this encourages retailers to offer even more and better deals to attract more customers. In the United States alone Cyber Monday sales grew from $610 million in 2006 to more than $2 billion in 2014 .

The deals on Cyber Monday are offered not only by big retailers but also by the smaller ones with more emphasis on clothing. Cyber Monday quickly becomes popular around the world and is currently observed, among others, in Canada, United Kingdom, Brazil, Portugal, Germany, Netherlands, Chile, Colombia, Peru and Japan.

Cyber Monday is a marketing invention that was first observed in 2005 by online retailer Seen as an online version of Black Friday, Cyber Monday was created to allow customers to shop online from the comfort of their offices and homes.

The day after Thanksgiving in the United States is traditionally considered to be the beginning of the Christmas shopping season. On this day, brick and mortar retailers have sales and provide massive discounts to attract customers, making it one of the busiest shopping days of the year. As a result, many people tend to stay away from stores to avoid crowds. Additionally, thanksgiving weekend is also one of the busiest travel weekends in the US when people travel around the country to be with their families. Such travel may mean that many customers miss Black Friday deals and sales. It is thought that Cyber Monday was created as a way to encourage such customers to shop without having to visit brick and mortar stores.

Sales and Discounts

Online retailers offer deals, often posting the kind of deals and sales they will have on online forums and websites, several weeks and days ahead. It is thought that a large percentage of the shopping on this day is done during work hours. Keeping this in mind, several retailers offer extra lunchtime discounts to their customers.

Several other countries, including Canada, Germany, and the United Kingdom also now have their own version of Cyber Monday.

As the dust settles on Black Friday and Cyber Monday 2016, one thing is clear: they continue to be massive commerce events and the most important two days of the year for Shopify merchants.

To help illustrate just how these days compare to a regular shopping day, we crunched the numbers and shared our most interesting findings below.

A massive spike in orders

It’s no secret that Black Friday and Cyber Monday outperform the average November shopping day, but what’s really interesting is the amount of transactions that Shopify processed at its peak—a staggering $555,716.

The most popular hours to shop

Interestingly, we discovered an eight hour difference in peak order times between shopping days. On Black Friday, order traffic steadily increased until hitting a 12 p.m. peak. During Cyber Monday, shoppers took a mid-evening break before peaking at 9 p.m. If you noticed that 3 a.m. bump early Friday morning, we’re guessing those were west coast shoppers snagging deals at midnight (PST).

Worldwide growth

Since its inception in 1959, Black Friday has been largely regarded as an American holiday. But in the past few years, and due in large part to the ever-increasing popularity of online shopping, the frenzy has started to catch on worldwide. Spain saw the largest increase in Black Friday orders on Shopify over an average shopping day, but significant growth was also spotted in Denmark, Canada, and the U.K.

The shift to mobile

Over Black Friday, we saw significantly more orders originating from mobile devices—a trend that started last year and continued to grow in 2016. The story changed for Cyber Monday, which saw mobile orders dip below desktops by a narrow margin.
